Terms of Service
1. Acceptance of Terms
By accessing or using BeyondAEC services — including our website, client dashboard, and any rendered deliverables — you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all visitors, clients, and team members.
2. Services & Deliverables
BeyondAEC provides subscription-based 3D visualization services for civil engineering firms, including 3D typical section renders and photo composites. Specific deliverable quantities are defined by the subscription plan selected at the time of signup:
- Core — 5 typical sections or 1 photo composite per month
- Elite — 8 typical sections + 2 photo composites per month
- Pro — 20 typical sections + 5 photo composites per month
Unused renders do not roll over to the next billing cycle. Animated fly-throughs and custom deliverables are available by separate quote only and are not included in subscription plans.
3. Subscription & Billing
Subscriptions are billed monthly on the date of signup. By subscribing, you authorize BeyondAEC to charge your payment method on a recurring monthly basis until you cancel. All fees are non-refundable except as required by law. You may cancel at any time; access continues through the end of the paid billing period.
Late or failed payments may result in suspension of service until the outstanding balance is resolved.
4. Intellectual Property
Upon receipt of full payment, the client is granted an irrevocable, worldwide, royalty-free license to use all delivered renders for any purpose including DOT proposals, public presentations, marketing materials, and permit applications.
BeyondAEC retains ownership of all underlying production assets, custom 3D models, shaders, and proprietary workflows used to produce renders. Source files are not included unless explicitly agreed upon in writing.
5. Client Responsibilities
Clients are responsible for providing accurate source materials (CAD files, measurements, plan sets, or photos) required to complete renders. BeyondAEC is not responsible for errors resulting from inaccurate or incomplete source materials provided by the client.
6. Revisions
All plans include two (2) revision rounds per render. Revisions must be submitted within 14 days of render delivery. Requests beyond the included revision rounds will be quoted separately.
7. Limitation of Liability
To the maximum extent permitted by law, BeyondAEC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client in the three (3) months preceding the claim.
8. Termination
BeyondAEC reserves the right to terminate or suspend access to its services at any time for violation of these terms, fraudulent activity, or failure to maintain payment. Clients may cancel their subscription at any time through the billing dashboard.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in [Your County], [Your State].
10. Changes to Terms
We reserve the right to update these terms at any time. Continued use of BeyondAEC services after changes constitutes acceptance of the revised terms. We will notify active subscribers of material changes via email.
Privacy Policy
1. Information We Collect
BeyondAEC collects the following categories of information to provide our services:
- Account information — name, email address, company name, and password (hashed)
- Billing information — processed securely through our payment processor; we do not store card numbers
- Project files — CAD files, PDFs, images, and other materials you upload
- Usage data — pages visited, actions taken within the dashboard, browser type
- Communications — messages sent through our contact form or email
Encryption
All data is protected by AES-256 encryption at rest and TLS 1.3 in transit.
No Data Selling
We never sell, rent, or trade your personal information to third parties.
2. How We Use Your Information
We use collected information to: deliver and improve our services, process payments, communicate project status, respond to inquiries, and comply with legal obligations. We do not use your information for third-party advertising or retargeting.
3. Third-Party Services
We use trusted third-party providers to operate our platform, including cloud hosting, payment processing, and email delivery. These providers are contractually bound to protect your data and may not use it for their own purposes. We do not share personal data beyond what is necessary to operate the service.
4. Data Retention
We retain account and project data for as long as your account is active or as required by law. Upon account cancellation, personal data is deleted within 90 days except where retention is required for legal or financial compliance. Project files may be retained for up to 12 months for support purposes.
5. Your Rights (GDPR & CCPA)
Depending on your location, you may have the right to: access the personal data we hold about you, request correction or deletion of your data, object to or restrict processing, and request data portability. To exercise any of these rights, contact us at info@beyondaec.com.
6. Cookies
Our website uses essential cookies to maintain your login session and preferences. We do not use tracking pixels or third-party advertising cookies. You may disable cookies in your browser settings; however, some features of the dashboard may not function correctly without them.
SMS / A2P Messaging Policy
A2P 10DLC Compliant
BeyondAEC sends transactional SMS messages through registered Application-to-Person (A2P) 10DLC messaging in compliance with CTIA guidelines and carrier requirements.
1. Consent to Receive SMS Messages
By providing your mobile phone number and checking the consent box during account registration or order submission, you expressly consent to receive text messages from BeyondAEC at the number provided. Consent is not a condition of purchase. Message and data rates may apply.
2. Types of Messages Sent
BeyondAEC may send the following categories of SMS messages:
- Order status updates (e.g., render started, render ready for review)
- Revision round notifications
- Account and billing alerts
- Team invitation notifications
- Appointment or deadline reminders
We do not send promotional or marketing SMS messages without separate explicit consent.
3. Message Frequency
Message frequency varies based on your account activity and project volume. You may receive up to 5 messages per active project per week. Recurring messages are sent only when triggered by project milestones or account events.
4. Opt-Out Instructions
You may opt out of SMS messages at any time by replying STOP to any message from BeyondAEC. After opting out, you will receive a single confirmation message and no further SMS will be sent. To re-enroll, reply START or update your notification preferences in your account dashboard.
5. Help
For help, reply HELP to any SMS message or contact us at info@beyondaec.com. Carriers are not liable for delayed or undelivered messages.
6. Supported Carriers
SMS messaging is available through all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and regional carriers. Message delivery is not guaranteed on all carriers or in all areas.
7. Privacy of SMS Data
Your mobile number is used solely for transactional messaging related to your BeyondAEC account. We do not share your mobile number with third parties for marketing purposes. Mobile numbers are stored securely and subject to the same data protections described in our Privacy Policy above.
